END USER LICENCE AGREEMENT (EULA)

Governing the "Thirteen" (Chat 13) Mobile Application and Related Services

Jurisdiction: Kingdom of Saudi Arabia

PLEASE READ THIS AGREEMENT CAREFULLY. IT CONTAINS A ZERO-TOLERANCE POLICY FOR OBJECTIONABLE CONTENT AND ABUSIVE USERS, AND IT LIMITS THE COMPANY'S LIABILITY.

This End User Licence Agreement ("EULA" or "Agreement") is a binding agreement between you ("User," "you," or "your") and Company MASHROUA AL-THALITH ASHAR For IT Systems, a company registered in the Kingdom of Saudi Arabia under Commercial Registration No. 4030367847, with its registered office at 7562 King Abdulaziz Rd, Ashati 3569, Jeddah 23513, Kingdom of Saudi Arabia ("Company," "we," "us," or "our"), governing your use of the mobile application "Thirteen" (also distributed as "Chat 13") and any related websites, features, and services (collectively, the "Services").

This EULA incorporates, and is supplemented by, our Terms and Conditions of Use and our Privacy Policy. Where this EULA and the Terms and Conditions of Use address the same subject, they are to be read together; the Terms and Conditions of Use govern in the event of a direct conflict.

1. Acceptance

You must affirmatively accept this EULA inside the application, by tapping "I Agree" (or a similarly worded acknowledgment) during account creation, before you may register an Account or use the Services. If you do not accept this EULA, you may not use the Services. Your continued use of the Services after we publish an updated EULA constitutes acceptance of the updated version.

2. Age Requirement and Age Rating

You may use the Services only if you are at least eighteen (18) years of age and have the legal capacity to enter into a binding contract. Because the Services carry user-generated content that is not pre-screened, the application is rated 18+ in the Apple App Store and rated for adults only (18+) in Google Play. We may request proof of age at any time, and we will terminate any Account we believe belongs to a person under eighteen (18) and delete the associated Personal Data in accordance with the Privacy Policy.

3. Licence Grant and Restrictions

Subject to your compliance with this EULA, the Company grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use one copy of the application on a device you own or control, solely for your personal, non-commercial use. You may not: copy, modify, translate, reverse engineer, decompile, or disassemble the application except to the extent permitted by Applicable Law; rent, lease, lend, sell, redistribute, or sublicense the application; remove or alter any proprietary notices; use the Services to build a competing product; or circumvent, disable, or interfere with any security, moderation, filtering, rate-limiting, or reporting feature of the Services. The application is licensed to you, not sold.

4. Zero Tolerance for Objectionable Content and Abusive Users

THE COMPANY HAS ZERO TOLERANCE FOR OBJECTIONABLE CONTENT AND FOR ABUSIVE USERS. THERE ARE NO WARNINGS AND NO EXCEPTIONS FOR SERIOUS VIOLATIONS.

"Objectionable Content" means any content or conduct that is abusive, harassing, bullying, threatening, hateful, defamatory, obscene, pornographic or sexually explicit, gratuitously violent, that promotes self-harm, terrorism, extremism, or any illegal activity, that sexualizes, exploits, or endangers a minor, that infringes the rights of any person, that discloses another person's private information without consent, that constitutes spam or fraud, or that is otherwise offensive to public order, religious values, or public morals under Applicable Law.

By accepting this EULA you agree that you will not create, upload, post, send, or transmit Objectionable Content, and that you will not harass, abuse, threaten, stalk, impersonate, or otherwise harm any other User — including by using the temporary anonymity of Anonymous Mode. This obligation applies to all content you send through the Services, whether or not it is sent anonymously.

You acknowledge and agree that Objectionable Content will be removed, and that the Account responsible for it will be suspended or permanently terminated and ejected from the Services, with no right of appeal, refund, or compensation. Conduct that may constitute a criminal offence may be reported to the Public Prosecution, the Communications, Space and Technology Commission ("CST"), or other competent Saudi authorities.

5. Safety Tools Available to You

5.1 Filtering. The Services apply automated filtering to content in transit, including keyword and pattern matching against a maintained list of prohibited terms, detection of sexual, hateful, violent, and abusive material, and spam, flood, and rate-limit controls. Content identified by these filters may be blocked before delivery, withheld from the feed, or queued for human review.

5.2 Flagging. You can flag Objectionable Content directly in the app. A report control is available on every individual message and on every group member, reachable by pressing and holding the message or by opening the member's profile, including for messages sent during or shortly after Anonymous Mode. You may also report to [email protected].

5.3 Blocking. You can block any abusive User directly in the app, from that User's profile, from the group member list, or from the message itself. A blocked User can no longer message you, contact you, or interact with your content, and their content is hidden from your view. Blocking takes effect immediately, applies during Anonymous Mode, and requires no approval from us.

5.4 Immediate Removal. You can delete content you have posted at any time, and it is removed from the feed for all members immediately. You may also hide or remove other Users' content from your own feed, and a group creator or administrator may remove content posted in that group.

6. Our Enforcement Commitment: Action Within 24 Hours

The Company will review every report of Objectionable Content and will act on it within twenty-four (24) hours of receiving the report. Where a report is substantiated, we will remove the offending content and eject the User who provided it by suspending or permanently terminating that Account. We may additionally restrict that User's access to Anonymous Mode permanently and report the matter to the competent Saudi authorities. Content under review may be withheld from the feed while the review is carried out.

7. Contact Information for Reporting

Our contact information is available inside the application, under Settings, so that any User can report inappropriate activity or abusive Users directly to us. You may also contact us at [email protected] at any time. We acknowledge reports of Objectionable Content and inform the reporting User of the outcome where we are able to do so.

8. Your Content

You retain ownership of the content you create. By sending, posting, or storing content through the Services, you grant the Company a limited, non-exclusive, royalty-free, worldwide licence to host, store, transmit, reproduce, and display that content solely to the extent necessary to operate, secure, and improve the Services, to enforce this EULA, and to comply with Applicable Law. You represent that you hold all rights necessary to grant this licence and that your content does not violate this EULA, the rights of any third party, or any Applicable Law.

9. Account Deletion

You may delete your Account at any time from within the application, or by writing to [email protected]. See our account deletion page for what is deleted, what is retained, and for how long.

10. Termination

This EULA remains in effect until terminated. Your licence terminates automatically, without notice, if you fail to comply with any of its terms, and the Company may suspend or terminate your access to the Services at any time where it believes you have violated this EULA or created legal risk for the Company. On termination you must cease all use of the application and delete it from your devices.

11. Disclaimer and Limitation of Liability

The Services are provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by Applicable Law. Content on the Services is created by Users, not by the Company, and while we filter, moderate, and enforce as described above, no moderation system is perfect. To the fullest extent permitted by Applicable Law, the Company Parties are not liable for indirect, incidental, special, consequential, or punitive damages, or for content created by other Users, save that nothing in this EULA excludes liability that cannot be excluded under Applicable Law. The full disclaimers and liability limits are set out in Sections 15 and 16 of the Terms and Conditions of Use.

12. Apple App Store Terms

Where you obtained the application from the Apple App Store, the following additional terms apply, and Apple Inc. ("Apple") is a third-party beneficiary of this EULA with the right to enforce it against you:

• This EULA is concluded between you and the Company only, and not with Apple. The Company, not Apple, is solely responsible for the application and its content.

• Your use of the application must comply with the Apple Media Services Terms and Conditions, including the Usage Rules.

• Apple has no obligation to furnish any maintenance or support services for the application. Support requests should be directed to [email protected].

• In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the application. To the maximum extent permitted by Applicable Law, Apple has no other warranty obligation whatsoever with respect to the application.

• The Company, not Apple, is responsible for addressing any claims by you or any third party relating to the application, including product liability claims, claims that the application fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

• The Company, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of any third-party claim that the application infringes that third party's intellectual property rights.

• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

13. Governing Law

This EULA is governed by the laws of the Kingdom of Saudi Arabia, and the competent courts of the Kingdom of Saudi Arabia have exclusive jurisdiction over any dispute arising out of or in connection with it, as further described in Sections 19 and 20 of the Terms and Conditions of Use.
